    Just the other day I was sitting on my computer, with the TV going at the same time. Suddenly, I heard something on the TV that caught my attention. I turned to look and saw that America’s Funniest Videos was playing clips of people falling…WITH THE BREAKFAST MACHINE AS BACKGROUND MUSIC!!! This just totally shocked and disturbed me because while, yes, the soundtrack was to a comedy, it just didn’t fit into that. I thought it was cool that it was being used but it bothered me that it was being used on a underrated show as simple background music that was not credited. Now you may think that I am blowing this out of proportion, but I think they should use music that fits the certain theme of the show, instead of pulling something out because it was by someone famous (I think that is why they used it). In all aspects, I don’t think this was a good thing to do, and I even wonder if Elfman had any say in it. If it was my music, I would tell the show to go shove their offer up their… well, you know. Once again, NON-credited.

    You can rest assured that a nationally broadcast television show like AMHV did all the legal paperwork to secure the rights to use the piece. Those rights would be secured through Warner Bros., the company that owns “Pee-Wee’s Big Adventure” and all of the musical material in it, or through ASCAP or BMI, the two major music rights protection agencies. I’m also sure Elfman is aware that this kind of thing goes on, since he has to sign contracts regularly that basically inform him that he will not own the rights to the music he writes for a movie. (Look on the notes to MFADT and you’ll see that even for a compilation of his own work, the album has to list all of the studios that own the music.)

    I’ve watched my fair share of AFHV, and I can say that they don’t JUST choose music because “someone famous” wrote it. They have some very famous stuff, and they have some really obscure stuff that no one’s ever heard.

    I’m not sure why you were disturbed. I saw that episode, too (it’s a re-run), and not only thought the music fit nicely, but was proud to know that the long-scorned Elfman was infiltrating farther and further than anyone back in the mid-80’s ever expected. Go, Elfman!

    Of course it didn’t fit!! A non-funny show with brilliantly hilarious music. . . doesn’t quite match up. (Always hated that show. Seeing people fall off houses is not my idea of funny. And that’s about the extent of it!)

    Correction: I’ve gotten into far too many debates in which I really had no place being…I’m going to stay out of this one. It’s part of my new policy of isolationism

    Yeah, and I would never have had to find a MP3 of it if I had the MONEY to buy the album, which I will when I do get the money. But as of now I am poor, and just because I am poor does that mean that I can’t listen to Danny’s music?

    Speaking political — go watch Kurt Russel in Tombstone and Kevin Costner in Wyatt Earp and tell me Bush isnt pulling an OK CORRAL with Iraq.

    If you’re poor and cannot afford food, then you’ll have my pity. If you’re poor and cannot afford music, and intend to steal it, then don’t expect anything from me.

    I truly believe that theft is theft — regardless of who owns what. I’ll never buy the argument that someone is too “poor” to buy music. If you’re poor, then you shouldn’t be indulging yourself on throwaway things like music. You should be making ends meet and getting on with your life. You don’t drive a stolen car, or live somewhere for free. You have to pay for everything……. And that includes music.

    I’m broke–trust me, I’m broke! (Getting an education and all will do that to a person)….but I’m not flat broke.

    And, I’m always willing to sacrifice lunch for a week, the movies–what ever it takes–just to get my hands on an Elfman score. I mean, it’s not that much money (–and this comes from someone who grew up in low-income housing)!

    Plus, his scores don’t tend to float around forever–best grab ’em while you can!

    Now that would be somthin’, eh? A peaceful world where you don’t have to pay for your own car or pay for food or shelter. Think of how happy all those starving homeless people would be! Ah, if only I could download a giant mansion.

    Here’s a question for anyone:

    A friend of mine recently got the Midnight Run score off of eBay, and he offered to make me a copy. I accepted. It’s out of print, according to my knowledge, and as such, I have no qualms about copying it. The money is no longer going to Danny, or even a middleman (excepting the private citizen who sold it on eBay), and therefore, I don’t see it as “stealing.” If any score that I want is in print, I always buy the original recording. I only accept copies of scores if they are out of print, and as such, the money used to buy that recording no longer benefits Danny or the record company. Hey, that’s just my reasoning…jump down my throat if you must…

    And yes, I also agree with Ryan about the “being poor” comment. It always ticked me off in college when kids would whine and say “I’m poor. I can’t go out to the bars this weekend.” My response to them was: “Obviously you’ve never been really poor…you can still eat and have a roof over your head.” Although I’m barely making ends meet right now (in terms of paying off student loans, paying the rent, etc), I have always been able to afford a place to live and something to eat. For that, I am very grateful…especially considering the situation in Iraq and Afghanistan.

    I don’t consider it “stealing” music if something is out of print, or near impossible to find. Likewise, I don’t consider it ripping an artist off if you burn a c.d. for someone who had no intention of buying that specific c.d. in the first place (this would be in hopes of yanking one or two of your friends into the Elfman mind set–usually to no avail, the dorks!).

    Plus, I have no problem with copying someone one or two songs and/or scores–again, under the assumption that since they only like a couple of pieces, they wouldn’tve bought the c.d. in the first place.

    I’d say it is stealing if you go crazy; if you start to grab everything you ever wanted just because you can–I mean what’s the difference between that and shop-lifting? Likewise, if you start to burn crap, and make profits off of doing so–then I’d say it’s bluntly stealing.

    But I do tend to think that anyone who has access to a computer and the internet should be able to come up with the money to buy a newly-released c.d.–especially if they want it bad enough.

    Of course, all of this is just my opinions and such–(and are probably just invented to ease my own conscious–although I rarely copy anything), but that’s how I look at the whole situation.

    Ryan, I seen to have made you mad. You forgot the most important thing that I said: When I get the money, I will buy it. And guess what, I got some money, and went out and ordered the Edward Scissorhands score. It was not my intention to steal it, I was just low on money, and I really wanted to hear it it the mean time. If I was never going to buy it, yes, I see where you are coming from, but I had planned to, and I think it is unfortunate that you think that people who are down on thier luck shouldn’t listen to music, as music is life to me.

    I also find it kinda’ funny that everyone that’s so uptight about downloading MP3s over the internet wound up writing about it in the America’s Funniest topic. ;)
